Attorney
Peter Lembesis is an experienced commercial litigator who has appeared before state and federal courts across New Jersey and New York, and before the American Arbitration Association. He has experience overseeing multiple facets of a variety of civil litigation matters, including shareholder and partnership disputes, trust and estates litigation, foreclosure prosecution and defense, consumer finance/creditors' rights litigation, commercial landlord-tenant disputes, construction surety litigation, employment actions, general commercial litigation, and personal injury actions. Peter has also successfully tried to completion a number of matters before judges and juries across the State of New Jersey. He has received judicial appointments from courts throughout the State, including as a special discovery master and condemnation commissioner. He currently serves as a member of the New Jersey District IIB (Bergen County – South) Attorney Fee Arbitration Committee and as a civil arbitrator for the Morris County Superior Court, Law Division. Additionally, Peter is a frequent presenter at continuing legal education seminars on the subjects of civil litigation and trial practice.
REPRESENTATIVE MATTERS
· Obtained a unanimous jury verdict on behalf of a commercial tenant suing its landlord for failure to remediate water and mold problems that prevented the tenant from opening a restaurant at the premises.
· Obtained a unanimous jury verdict on behalf of a business broker bringing claims against its former client for failure to pay commissions due upon the sales of the businesses marketed by the broker.
· Successfully defended, at trial, the majority shareholders of a restaurant and catering business from claims of minority shareholder oppression.
· Obtained judgment after trial on behalf of a plumbing supplier against a customer for a large construction project.
· Obtained judgment dismissing a petition filed by our client’s stepmother seeking to be appointed as administrator of our client’s father’s estate, and to divest our client of his interest in property owned jointly with his late father.
· Obtained summary judgment on behalf of a lender for a residential real estate development project.
